Indian railways have insured every rail passenger against his/her death or injury in train accident as defined under section 124 of the raiway’s act, 1989. Similarly every rail passenger and platform ticket holder is also insured against death or injury on account of untoward incident as defined under section 124 A of the railway’s (amendment) act 1994 such as death/inury on account of commission of a terrorist act, violent attack, robbery, dacoity, rioting, shoot out, arson by any person in any train carrying passengers or in the awting hall, cloak room, reservation or booking office or on any platform or in any other place wihttin the presmises of a raiway station of accidental falling of any passenger from a train carrying passengers. However, no compensation shall be payable under this section if a passenger dies or suffers injury due to (a) suicide or attempted suicide. (b) Self-inflicted injury (c) His own criminal act (d) Any act committed by him in a state of intoxication or insanity (e) Any natural cause or disease The dependents of dead or injured passenger or his authorized agent have to approach railway claims tribunal of the respective state which decides the claims. Compensation for death or permanent disability is Rs 4 lakes. In case of injuries the minimum amount is Rs 32,000 and maximum is Rs 3.60 lakes depending upon the gravity of injury as per schedule.
