The Texas Election Code prohibits political parties fromaccepting or spending corporate funds except in narrowcircumstances. Tex. Election Code Section 257.002 states: Apolitical party that accepts a [corporate] contributionauthorized by Section 253.104may use the contribution onlyto:(1) defray normal overhead and administrative oroperating costs incurred by the party; or (2) administer aprimary election or convention held by the party. The TexasEthics Commission has consistently interpreted this provisionto authorize political parties to spend corporate money onlyon routine administrative expenses of the party, and not onpolitical brochures, voter registration drives, and otherpolitical activity. Tex. Ethics Op. Nos. 176 (1993); 272(1995). A violation of chapter 257 is a Class A misdemeanor.Tex. Election Code 257.006 (b). According to disclosure records with the Federal ElectionCommission, the Republican Party of Texas created aseparate soft money account - Texas RepublicanCongressional Committee aka Texas Victory 2002 - whichreceived transfers of corporate funds from the stateRepublican Party. The Texas Republican CongressionalCommittee then spent some of those funds on voterregistration drives and voter mobilization activities withinTexas. The Houston Chronicle reported on April 25, 2004 that theRPT transferred $5.7 million from its separate corporateaccount to the Texas Republican Congressional Committee(TRCC). (Article attached) These transfers can be verified onthe TRCCs federal election forms, Schedule H3, athttp://herndon2.sdrdc.com/dcdev/(Federal Id. No.C00143743). The FEC records indicate that such transfershave occurred over a period of several years. (Samplesattached) The TRCC then spent a substantial portion of thefunds on what appears to be non-administrative expenses,such as political mailers, polling, list acquisition, voterregistration, and political consultants. The RPTs transfers andexpenditures appear to violate Texas Election Code Section257.002. Please investigate this matter. Thanking you.
